Terms of Service

These Terms of Service ("Terms") are a binding legal agreement between you (the "Developer" or "Customer") and Porfolio LLC, a Florida limited liability company ("Company," "we," "us," or "our"), governing your use of the authentication service known as Mindful Auth (the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you are agreeing on behalf of a company, you represent that you have the authority to bind that entity.

1. The Service

Mindful Auth is a B2B authentication platform designed for professional developers. The Service operates as a serverless infrastructure layer running on Cloudflare.

2. Eligibility & Accounts

  • Professional Use: The Service is intended for professional developers and businesses.
  • Account Responsibility: You are responsible for maintaining the security of your account and any API keys issued to you. You are liable for all activities that occur under your account.

3. Usage Plans & Action Quotas

  • Tiers: We offer Free (25K actions), Pro (750K actions), and Business (2M actions) tiers.
  • Actions: An "Action" is defined as any successful authentication request or API call processed by Mindful Auth.
  • Quota Limits: Each plan has a specific monthly action quota. When your allocated actions reach zero (0), the Mindful Auth API will stop functioning for your application. Service will only resume when:
    1. Your monthly quota resets at the beginning of the next billing cycle, or
    2. You purchase additional action credits.
  • Usage Monitoring: You are solely responsible for monitoring your action usage through the Developer Dashboard. Usage metrics within the dashboard are automatically refreshed every six (6) hours. Developers may utilize the manual "Refresh Actions" button within the dashboard to synchronize and view the most current consumption data. Porfolio LLC is not liable for service interruptions resulting from your account reaching its allocated limit, regardless of any latency in the dashboard's automatic refresh cycle.
  • Payments: All billing and tax compliance are handled via Stripe. You agree to provide valid payment information and authorize recurring charges based on your selected plan.

4. Acceptable Use Policy

You agree not to, and not to allow your end-users to, use the Service to:

  • Illegal Content: Facilitate, host, or authenticate users for any application containing illegal content, including but not limited to child sexual abuse material (CSAM).
  • Illegal Substances: Promote, sell, or distribute illegal drugs or controlled substances in violation of applicable laws.
  • Violence & Terrorism: Support, promote, or facilitate terrorism, violent extremism, or the activities of designated terrorist organizations.
  • Extremism & Hate Speech: Host or facilitate applications for extremist groups, or those promoting hate speech, discrimination, or harassment based on race, religion, gender, sexual orientation, or any other protected characteristic.
  • Malicious Activities: Engage in phishing, credential stuffing, or the distribution of malware.
  • Infrastructure Interference: Reverse engineer, decompile, or attempt to extract the source code of the Mindful Auth edge runtime, or conduct stress tests/vulnerability scans without prior written consent from Porfolio LLC.

Porfolio LLC reserves the right to determine, in its sole discretion, whether an application violates this Acceptable Use Policy and to take immediate action, including account termination.

5. Data Ownership & Security

  • Developer Ownership: You retain all rights, title, and interest in and to the application data you process through the Service.
  • Zero Persistent PII Storage: Mindful Auth does not collect, process, or store personal identifiers belonging to your application's end-users (such as names, email addresses, passwords, or biometric data) in any persistent database.
  • Processing of Technical Metadata: You acknowledge and agree that Mindful Auth processes and temporarily stores encrypted technical metadata (including session identifiers, login attempt records, and geolocation data) solely to provide the Service and enforce security protections. This data is handled in accordance with our Privacy Policy.
  • Security Infrastructure: Mindful Auth employs advanced security measures, including a Six-Layer Defense System, Cloudflare Turnstile integration, Velocity Tracking, and Per-Tenant Key Derivation. These features are designed to mitigate automated attacks and harden the authentication layer.
  • Shared Responsibility: Security is a shared responsibility. While Porfolio LLC provides the infrastructure and defense layers, you are responsible for the secure implementation of the Service within your application, the security of your own backend systems, and the protection of your Developer API keys as detailed in our documentation.

6. Templates and Developer Modifications

  • Approved Frameworks: Developers may only use the backend frameworks officially supported and provided by Mindful Auth. Use of unauthorized or unsupported backends is prohibited.
  • Replication & Custom Platforms: If you attempt to replicate or port a Mindful Auth frontend template to a platform for which we have not provided an official template, you do so at your own risk. Porfolio LLC does not provide technical support for custom implementations on unsupported platforms.
  • Required Structure: Official templates rely on specific file structures, scripts, and configurations to maintain a secure connection with the Mindful Auth API.
  • Modification Disclaimer: Making significant modifications to templates may break the authentication handshake. Porfolio LLC is not responsible for malfunctions resulting from your modification of the provided templates.
  • New Backend Requests: Requests for additional backend implementations must be submitted as feature requests. Porfolio LLC does not guarantee the addition of any requested backend; implementation is decided at our sole discretion based on technical feasibility and market demand.

7. Service Level Agreement & Dependencies

  • Third-Party Dependency: Mindful Auth relies entirely on the Cloudflare Workers platform. You acknowledge that if Cloudflare experiences downtime, Mindful Auth will be unavailable.
  • No Uptime Guarantee: While we strive for 100% availability, the Service is provided "as-is" without a formal uptime guarantee. In the event of an outage, your sole remedy is to wait for Cloudflare service restoration.

8. Feedback

We welcome feedback via our official Discord. By submitting feedback, you grant Porfolio LLC a perpetual, irrevocable, royalty-free license to use and implement your suggestions without compensation.

9. Limitation of Liability

9.1 No Liability for External Breaches: To the maximum extent permitted by law, Porfolio LLC shall not be liable for any data breaches or unauthorized access occurring on the Developer's infrastructure, backend databases, or third-party integrations.

9.2 Social Engineering & Phishing: You acknowledge that even with the Service's security features, end-users may be susceptible to phishing, social engineering, or credential harvesting attacks. Porfolio LLC is not responsible for the loss or theft of end-user credentials resulting from such attack vectors or any user-side security failures.

9.3 Modification & Custom Implementations: Porfolio LLC shall not be liable for any errors or failures caused by your modification of provided templates or your attempts to implement the Service on unsupported platforms or backends.

9.4 General Limitation: OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Dispute Resolution & Arbitration

  • Governing Law: These Terms are governed by the laws of the State of Florida, USA.
  • Good Faith Negotiation: Before filing any formal claim, you agree to notify us at legal@porfol.io and attempt to resolve the dispute informally for at least 30 days.
  • Binding Arbitration: Any unresolved dispute shall be settled by binding arbitration in Florida, administered by the American Arbitration Association (AAA).
  • Exceptions: Porfolio LLC may seek injunctive relief in any court of competent jurisdiction for violations of Section 4 (Acceptable Use) or Intellectual Property theft.

11. Termination

You may cancel your subscription at any time through your dashboard. Porfolio LLC reserves the right to terminate accounts immediately that violate the Acceptable Use Policy in Section 4 or those that remain inactive for more than 12 months on a Free plan.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on our website or through the Service dashboard. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." PORFOLIO LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

14. Indemnification

You agree to indemnify, defend, and hold harmless Porfolio LLC and its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content or applications you develop using the Service.

15. Force Majeure

Porfolio LLC shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials, or large-scale internet or infrastructure failures.

16. Severability and Waiver

If any part of these Terms is held invalid or unenforceable, that part will be construed to reflect the parties' original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of these Terms or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.

17. Assignment

You may not assign your rights under these Terms to any other party without our prior written consent. Porfolio LLC may assign its rights under these Terms without condition. These Terms will be binding upon and will inure to the benefit of the parties, their successors, and permitted assigns.

18. Entire Agreement

These Terms constitute the entire agreement between you and Porfolio LLC regarding the Service.
